These Terms of Service (“Terms”) govern your use of the Three Peaks Media website, services, tools, content, and any work we perform for you. By accessing or using our website or engaging with us for services, you agree to these Terms.

1. About Three Peaks Media

Three Peaks Media (“we,” “us,” “our”) is a marketing, technology, and automation studio offering services including AIO (AI + SEO + content), SEO, media buying, analytics, custom development, integrations, CRM setups, tracking systems, AI agents, and related consulting.

Our website is for informational purposes. Nothing here guarantees results, performance, or outcomes unless explicitly stated in a signed agreement.

2. Use of Our Website

You agree not to:

  • Attempt to hack, disrupt, or misuse the website
  • Scrape, copy, or redistribute content without permission
  • Use our site for abusive, malicious, or unlawful purposes
  • Interfere with servers, APIs, or hosting infrastructure
  • Use automated tools to collect data or overload the system

We may suspend access if we detect misuse or suspicious activity.

3. Information You Provide

When you contact us or submit forms, you agree that:

  • All information you provide is accurate
  • You have the right to share any data you upload
  • You won’t submit illegal, harmful, or sensitive personal data unless explicitly agreed to in writing
  • You’re responsible for ensuring your submissions comply with applicable laws

4. Client Engagements & Project Work

Any project, retainer, or engagement with Three Peaks Media requires a separate written agreement, proposal, or contract. This may include:

  • Scope of work
  • Deliverables
  • Timelines
  • Fees and billing structure
  • Intellectual property terms
  • Termination terms
  • Responsibilities of both parties

No work begins without mutual agreement. All work done is subject to:

  • Availability
  • Reasonable project timelines
  • Data access, credentials, and materials you provide
  • External platform limitations (Google, Meta, CRM tools, etc.)

We are not responsible for delays caused by lack of access, missing information, platform outages, or external issues outside our control.

5. No Guaranteed Results

Marketing, SEO, media buying, automation, and development outcomes depend on many external factors (market conditions, competition, platform algorithms, your product, your budget, and your own performance).

Unless explicitly stated in writing:

  • We do not guarantee specific rankings
  • We do not guarantee specific ROI or revenue
  • We do not guarantee specific traffic, lead volume, or campaign performance

We guarantee effort, transparency, clarity, and competent execution, but not results.

6. Payments & Billing (If You Become a Client)

Unless otherwise agreed in writing:

  • Payments are due according to the invoice or agreement
  • Late payments may incur delays, suspension of work, or interest fees
  • Work may pause until outstanding balances are cleared

For subscriptions, retainers, or recurring services:

  • You authorize us or our billing provider to charge your payment method
  • Cancellations must be communicated in writing
  • Some services may be non-refundable (as stated in our agreement)

All fees are stated in USD unless noted otherwise.

7. Intellectual Property

7.1 Website content

All content on this website (text, graphics, UI, branding) belongs to Three Peaks Media and may not be reused without permission.

7.2 Deliverables created for clients

Ownership is determined by the specific project agreement. In general:

  • You own final approved deliverables that you’ve paid for in full
  • We own internal tools, frameworks, templates, methods, code, scripts, or systems used to produce the work
  • We may reuse non-private techniques, processes, or generic components in other projects
  • We do not claim ownership of your trademarks, brand assets, or proprietary business data

8. Third-Party Tools & Integrations

Our services often interact with third-party platforms, such as:

  • Google Analytics, Search Console, Tag Manager
  • Meta, Google Ads, TikTok Ads
  • CRM platforms
  • SMS/call tracking providers
  • AI tools
  • Hosting and analytics tools

We are not responsible for:

  • Their outages
  • Their policies
  • Their data processing
  • Changes they make to pricing or features

By using our services, you agree to comply with third-party terms applicable to your platforms.

9. Confidentiality

We treat client information as confidential. We will not disclose your data, strategies, or materials unless:

  • You allow it in writing
  • It’s necessary to complete the project
  • Required by law
  • Part of anonymized, non-identifiable case studies (optional & agreed to separately)

Likewise, clients may not share our internal documents, proprietary processes, or internal work publicly without permission.

10. AI Use & Responsibility

Three Peaks Media may use AI tools to support research, automation, and content development. We commit to:

  • Not submitting sensitive data to AI without permission
  • Having human review for all AI-assisted output
  • Using AI as a tool, not a replacement for expertise

We are not responsible for AI model behaviors outside our control.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Three Peaks Media is not liable for indirect, incidental, special, or consequential damages
  • Our liability in any claim is limited to the amount you paid us in the last 3 months
  • We are not responsible for losses caused by third-party systems, hosting providers, ad platforms, CRMs, AI tools, or your internal decisions

You agree to use our website and services at your own risk.

12. Indemnification

You agree to indemnify and hold Three Peaks Media harmless from claims, damages, liabilities, or expenses arising from:

  • Misuse of our website
  • Violation of these Terms
  • Misrepresentation of information you provide
  • Illegal or unauthorized use of content, accounts, data, or platforms
  • Breaches of your own obligations to third parties

13. Termination

We may suspend or terminate website access, project work, or accounts if:

  • There is non-payment
  • There is abuse or misuse
  • There is illegal activity
  • There are violations of these Terms
  • There are security risks or suspicious conduct

You may terminate project engagements as specified in your separate agreement.

14. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Any disputes must go through:

  • Mandatory mediation first
  • Binding arbitration if mediation fails
  • No court litigation unless required by law

This section protects both parties from unnecessary legal battles.

15. Changes to These Terms

We may update these Terms at any time. If changes are material, we will update the “Last updated” date and may post a notice on the website. Continued use of our site or services indicates acceptance of updated terms.
